1. Contracting Parties
1.1 The mobile game app “FlyWorld” (hereinafter referred to as “the app”) is operated by Hindsight-Studios UG (limited liability), with its registered office at Grünen Weg 25, 45659 Recklinghausen (hereinafter referred to as “we”, “us”) referred to) or referred to as “Hindsight Studios”).
1.2 By installing, accessing or using the app, you expressly agree to these General Terms and Conditions (GTC).
2. Scope
2.1 These terms and conditions apply to all users of the “FlyWorld” app.
2.2 Any deviating terms and conditions of the user do not apply unless we have expressly agreed to them in writing.
3. Usage and Age Restrictions
3.1 People under the age of 18 are only permitted to use the “FlyWorld” app under the supervision of a legal guardian.
3.2 Parents or legal representatives are responsible for ensuring that the use of the App by minors is appropriately monitored and controlled.
3.3 We encourage parents or guardians to actively participate in children's use of the App and to educate them about the potential risks and content.
4. In-app purchases
4.1 The “FlyWorld” app offers in-app purchases that enable additional functions, virtual items or currencies in the game.
4.2 By purchasing content within the app, you agree to the payment terms of the respective app store. We are not responsible for any transaction issues or chargebacks.
4.3 Any disputes or issues relating to in-app purchases should be directed directly to the applicable App Store provider.
5. Advertising
5.1 The “FlyWorld” app may contain third-party advertising that is displayed during use.
5.2 We accept no responsibility for the content, accuracy or availability of such advertising. The placement of advertising serves to finance the app and enables us to offer the app free of charge.
5.3 We are not responsible for the actions or products of advertisers promoted via the App.
6. Disclaimer
6.1 We are convinced that the “FlyWorld” app must always be kept functional and safe. However, we do not guarantee the availability, freedom from errors or security of the app.
6.2 You use the app at your own risk. We are not liable for any direct or indirect damage that may arise from the use of the app.
6.3 We accept no responsibility for any interruptions, failures or problems caused by any third party services or platforms.
6.4 Users are responsible for ensuring that their devices and software components are up to date and comply with security requirements.
7. Data protection
7.1 Information about the collection, use and disclosure of personal data by the “FlyWorld” app is described in detail in our privacy policy.
7.2 By using the app, you agree to the collection, processing and use of your data in accordance with our privacy policy.
7.3 We take appropriate security measures to protect your data, but we cannot guarantee absolute security.

8. Changes to the Terms and Conditions

10.2 The use of the App does not grant you any rights to this intellectual property. Any reproduction, distribution or use of content from the app without our express permission is prohibited.
10.3 You agree to provide any content you create or upload to the App to us on a non-exclusive, royalty-free, worldwide basis.
11. Rules of conduct
11.1 When using the “FlyWorld” app, you agree not to upload, share or distribute any content that violates applicable laws, third-party rights or these Terms and Conditions.
11.2 This includes, but is not limited to, content that is defamatory, offensive, obscene, threatening or discriminatory
11.3 We reserve the right to remove content and terminate accounts that violate these terms.
12. Termination
12.1 We reserve the right, at our sole discretion and without prior notice, to suspend or terminate your access to the "FlyWorld" app if we discover any violations of these Terms and Conditions or for any other reason at our sole discretion.
12.2 You have the right to delete your account and stop using the app at any time.
13. Right of cancellation
13.1 Please note that digital in-app products such as diamonds, packages or other virtual items that can be used or redeemed directly after purchase are non-refundable. Once you have purchased these products and they have been redeemed, cancellation and refunds are excluded.
13.2 By purchasing and redeeming digital in-app products, you agree that your right of cancellation expires and that you waive your right of return as soon as the products have been used or redeemed.
13.3 However, in the event of technical problems or unauthorised purchases that have led to an unwanted redemption, you have the option of contacting our support team. In such cases, we will review your enquiry and offer a solution in accordance with our terms and conditions.
14. Applicable Law
14.1 The law of the Federal Republic of Germany applies exclusively to these general terms and conditions and the use of the “FlyWorld” app, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 All disputes in connection with these Terms and Conditions or the “FlyWorld” app are subject to the exclusive jurisdiction of the courts in Recklinghausen, Germany.
15. Severability clause
15.1 If individual provisions of these General Terms and Conditions are or become ineffective in whole or in part, the effectiveness of the remaining provisions remains unaffected.
15.2 Instead of the invalid provisions, an effective regulation applies that comes closest to the economic purpose of the invalid provision.
16. Final provisions
16.1 These Terms and Conditions constitute the entire agreement between you and us in relation to the use of the “FlyWorld” app and supersede all previous agreements.
16.2 Any deviations from these General Terms and Conditions must be in writing and must be expressly confirmed by us in writing.
16.3 We reserve the right to update these Terms and Conditions from time to time. Any changes will be posted on the app or our website.
